Overview

EDU Stream Ltd ("EDU Stream") respects the intellectual property rights of others and expects its users, instructors, and content partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applicable international copyright law, we have adopted the following policy regarding copyright infringement.

If you believe that content available on EDU Stream infringes your copyright, you may submit a written DMCA takedown notice to our designated agent as described below.

Submitting a Takedown Notice

To file a copyright infringement notification, you must submit a written notice that includes all of the following elements:

  1. Identification of the copyrighted work — describe the work you claim has been infringed (e.g., title, author, URL of the original).
  2. Identification of the infringing material — provide the specific URL(s) on edustreamed.com where the infringing material is located.
  3. Your contact information — name, postal address, telephone number, and email address.
  4. Statement of good faith belief — a statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  5. Statement of accuracy — a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.
  6. Signature — a physical or electronic signature of the copyright owner or authorised representative.

Incomplete notices will not be processed. Submitting a false or misleading DMCA notice may expose you to liability under 17 U.S.C. § 512(f).

We will acknowledge receipt within 5 business days and take appropriate action (which may include removing the reported content) as required by law.

Counter-Notice Procedure

If content you submitted was removed in response to a DMCA notice and you believe the removal was in error, you may submit a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the URL where it previously appeared.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the courts of England and Wales if you are outside the United States), and that you will accept service of process from the party who filed the original notice.

Send counter-notices to: dmca@edustreamed.com. Upon receipt of a valid counter-notice we will forward it to the original complainant. Unless the complainant files a court action within 10–14 business days, we may reinstate the removed material at our discretion.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, EDU Stream maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Platform for any user who infringes any intellectual property rights.

Good Faith & Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake, may be subject to liability for damages.

We encourage rights holders to consider whether fair use, fair dealing, or another exception applies before filing a takedown notice. If you are unsure, consult a qualified legal professional.
